This is the ordinance change that INC commented on. The city adopted it and
the county held off.

See below. Does anyone know if there is anything to thos that we citizens
need to worry about (loose language, loopholes, etc.)?

Also, Why havent the city and county versions of the UDO been streamlined,
so that they are consistent? Take the more stringent requirements of each
and put them into a cohesive UDO. This way, developers cant shop around for
the version that restricts them the least. It would also prevent a lot of
time (for both city/county staff and development teams) and should prevent
double rezoning cases - go to the county, and if they reject you, go to the
city...it is a waste of everyone's time and resources, especially for
citizens (who arent paid for their vigilance and input).

In thks regard, why cant we do the same with the Jordan and Falls Lakes
Rules (once they are finalized, of ever). Consistency not only makes sense,
it saves time and money (and confusion!).

On June 1, 2013, the Unified Development Ordinance (UDO), along with the
applications and forms for site plans and subdivisions within the Durham
City limits, will change. On March 18, 2013 the Durham City Council adopted
an ordinance to amend the UDO regarding discretionary regulations. The
amended UDO will become effective within the City limits on June 1, 2013.
This action was taken to comply with State statutes (N.C.G.S. § 153A-349 and
§ 160A-393) adopted in late 2009, which defined a quasi-judicial land use
decision as to include any site plan approval that involves discretionary
standards. These amendments to the UDO are not effective for submittals
within the County jurisdiction since the amendments have not been adopted by
the Board of County Commissioners at this time.

These changes have been posted on the Planning Department website. The link
for the Unified Development Ordinance
<http://durhamnc.gov/ich/cb/ccpd/Pages/Durham-Unified-Development-Ordinance.
aspx> now takes you to a web page that includes both the City and the
County versions of the UDO. Each Article is in pdf format, and contains a
footer on each page that clearly states “City of Durham Unified Development
Ordinance,” or “Durham County Unified Development Ordinance.” In addition,
the searchable web-based UDO has been removed until further notice due to
technical issues.
