INC NEWS - Bill 1152 -- please write the General Assembly with your opposition

At the JCCPC meeting this morning, I also learned
that: The NC General Assembly is considering an act to
require counties and cities to pay interest on
illegally exacted taxes, fees, or monetary
contributions for development that are not
specifically authorized by law.

There is pressure from developers to pass this
legislation, although doing so could inhibit the
city/county from imposing new taxes/fees that they
deem in the best interest of the county, because of
fear of litigation. A clear example of this is the
Durham County's somewhat recent imposition of impact
fees on new development, for which developers
successfully sued the county, but which nonetheless
was an impetus for passage of legislation that now
enables all NC counties to impose transfer fees on
real estate.

The JCCPC voted unanimously to contact the House and
Senate immediately with their opposition to this bill
(1152), since this legislation may very well pass the
house today and move on to the Senate.

I am writing to ask that you do the same. Please
contact your Representatives and Senators and ask them
to oppose Bill 1152.
