Dear Melissa,

We need your help to protect the health of North Carolinians from the toxic emissions of Cliffside, Duke Energy's proposed massive new coal plant.

Just months after a federal judge found Duke Energy violated the Clean Air Act, the North Carolina Division of Air Quality changed the terms of an air permit to allow the utility to emit pollutants like mercury, arsenic, and dioxins at the proposed Cliffside Unit 6 at levels other states have found unacceptable.

For three years, Duke Energy stated its Cliffside addition was a "major" source of toxic air pollution. For three years, the utility claimed the new coal boiler would emit over 171 tons of hydrochloric acid gas per year. But immediately after the court ruled Duke hadn't achieved adequate pollution controls, the utility petitioned the state's Division of Air Quality, claiming the unit would emit not 171 tons of toxic gas per year, but 10. That's an 88% reduction based on Duke's own calculations. Conveniently for Duke Energy, this single reduction brought the boiler just below the legal threshold requiring more protective pollution control measures that would significantly reduce harmful emissions of more than 50 other air pollutants.

Citizens rely on North Carolina’s Division of Air Quality to protect state residents. But by declaring the new boiler a "minor" source of hazardous air pollutants, public heath is being shortchanged.

Don't let Duke Energy get away with this! 

Join the Sierra Club in asking Lisa Jackson, head of the Obama Environmental Protection Agency, to intervene and protect North Carolina's air quality. Let her know you expect Duke Energy to comply with the Clean Air Act.
