[Durham INC] Homes sold in Durham minus mineral rights -- Fracking to come?

Perhaps we can have a resolution asking the city and county to require that the advertisements/listings/handouts/etc. explicitly state when any real-estate is to be sold without mineral rights (or any other rights associated with the land (to the mantle) and the space (to the sky)). 

Is there state or federal legislation prohibiting such a requirement?

This, as far as I know, is limited to DR Horton homes (builder out of TX).  But, as a real estate agent, this was news to me, too!  The disclosure is certainly not in advertisement.  I would like to see this stopped in future—somehow.

 Is this not being disclosed to buyers? Are we now going to have to purchase mineral rights separately from land/home? Could cities or counties prohibit this?
