What is added to the text of the UDO is
c. The area within utility easements of record (power, gas, water, sewer) that measure a minimum of 50 feet in width and exist at the time of application submittal.

On one hand, this makes sense as, like ponds, there isn't going to be a tree coverage there and the general theory is to require a % of tree coverage only on the part of the development where you can have trees.  

On the other hand, you have to have a pretty strong suspicion that someone needs this to fit in too much development on too little space to make his little plans work.

Text Amendment 
TC1300012 is a 
privately-initiated text amendment to 
paragraph 8.3.1C, Tree Coverage, of the Unified Development Ordinance, to allow 
the area for certain large, existing utility easements to be exempt from tree 
coverage calculations.
 
The text of the proposed amendment may be viewed at http://durhamnc.gov/ich/cb/ccpd/Pages/Text%20Amendments/Pending-Text-Amendments.aspx, 
and will be reviewed by the Joint City-County Planning Committee (JCCPC) on 
October 2nd to provide comments and additional policy direction. The 
JCCPC does not hold public hearings, although its meetings are open to the 
public. No public hearings have been scheduled at this time.
