I am in the process of writing up a resolution with some whereases.  
I'm trying to figure out what happened with the original TC120012 (which would have let developers calculate the number of units allowed based on including undevelopable road right of way and given a bonus for being on an access road as if the property were highway. One of the properties that the memo describes as a place the bonus for being where the major land-moving has been on the south side of 15-501 between the bridge and I40.  This is an academic exercise, I think, given the construction already going on there.  But it is a useful look.  It is 15.4 acres, and the original bonus (just considering tweaking the road bonuses) would have raised the effective density from 17.5 to 21.9, so the number of units from 269 to 337.  As I read the revised text, they would now get 19 units per acre or 293 units.  The thing is, we really want to close the access road, so most of the entry / exit to this property would be on the already chaotic Mt. Moriah Road.  They probably wouldn't quite have the number of units to require a traffic study.  
The other property considered is a sliver along the access road with the Pepsi Plant and Herald Sun building.  Since it has a lot of road right of way, it shows the unintended consequences of the original TC120012.
The other thing the memo says is that they want to have higher densities in proposed transit areas, which is exactly what they are giving up with new proposed changes.  
Oh, and the entity that requested the change is Horvath Associates, and the governing bodies by law have to consider it, but they don't have to give them anything.

Another thing that is is being slipped in that for urban multi-family, with a development plan, they are proposing that the density could go up to 20 units per acre (formerly 17.5).  In the suburban area, the increase for multifamily with development plan goes from 10.8 to 18.  I am emphatically not looking forward to that in my area.

THis is apparently a new version of the gift to some developer so they can fit a few more units into land they must have paid too much for in the first place.
In my mind, this is a pernicious and stupid way to solve the problem that if you have 1 acre, an upper limit of 3.5 units per acre gives you 1/2 a unit, which doesn't make sense.  However, they change the multiplier rather than do the reasonable option of rounding the result up (I'm sure they can find someone who can use the calculator to multiply with fractions).  Changing the multiplier means that someone with 20 acres gets 10 new units.  INC should be opposing this.

Please be advised of the upcoming Durham Planning Commission public hearing on proposed changes to the text of the Durham Unified Development
 Ordinance (UDO):  
 
Text amendment TC1200012 proposes changes to Article 6, District Intensity Standards, to revise certain density requirements, including:

1.      
Adjusting current density allowances to remove fractions of dwelling units;

2.      
Modifying the existing Residential Suburban-Multifamily (RS-M) Major Roadway Density Bonus to include frontage along service roads;


3.      
Allowing higher densities, but only with approval of the governing body through rezoning with a development plan; and


4.     
Allowing the use of density bonuses for multifamily development in non-residential districts in the Suburban and Compact Neighborhood Tiers, consistent with what is currently permitted
 within the Urban Tier.
 
The Durham Planning Commission will hold the public hearing on Tuesday, December 10, 2013, at 5:30 p.m. in the City Council Chambers at 101 City Hall Plaza, 1st Floor. 

 
Agenda materials will be available online by November 27, 2013. The text of the proposed change may be viewed at
