This is the definition of "independent living facility"
Independent Living Facility: A facility consisting of a single building or group of buildings with
one ownership and management in which the residents are persons at least 55 years of age,
their spouses, and/or their surviving spouses, and with or without an on-site resident manager.
Residents live in their own dwelling units. The facility maintains a common dining room and
typically provides personal services such as transportation, banking, and/or a barber shop/hair
salon; recreational activities and amenities; concierge services; and housekeeping for residents
and their guests. Health maintenance services and/or treatment are not provided.
They would be allowed with minor special use permits in RS-M, RU, RU-M, RC and PDR, and by right in some non-residential and design districts. They would require 0.6 parking spaces per unit (I would suggest that they do like congregate living and require some minimum parking for employees).
The UDO amendment also includes some tidying up of the use categories around household and group living.

Please be advised of the upcoming Durham Planning Commission public hearing on proposed changes to the text of the Durham Unified Development
Ordinance (UDO):
Text amendment TC140005 is a privately-initiated application to establish a new use called an “independent living facility.” The amendment provides the following:
Establishes the use within Article 5, Use Regulations;
Clarifies references to other similar uses within Article 5, Use Regulations;
Establishes parking requirements in Article 10, Parking and Loading; and
Provides a definition for the use in Article 16, Definitions.
The Durham Planning Commission will hold the public hearing on Tuesday, April 14, 2015, at 5:30 p.m. in the City Council Chambers at 101 City Hall Plaza, 1st Floor.
Agenda materials will be available online by March 23, 2015. The text of the proposed change may be viewed at
http://durhamnc.gov/ich/cb/ccpd/Pages/Text%20Amendments/Pending-Text Amendments.aspx. Interested parties may appear and speak at the public hearing. Substantial changes to the proposed action may be made following the public hearing. For more information
