The state legislation one includes the rather Orwellian name changes as well as loss of the protest petition, loss of the ability to legislate appearance of residential development and some finangles of some kind about stream buffers and impervious surface.
The "omnibus" update is also going to the governing bodies soon.
Text Amendment TC1500001 – Omnibus UDO Amendments #9. A text amendment consisting of technical revisions and minor policy changes to various provisions of the Unified Development Ordinance (UDO), including Article 1, General; Article 2, Review Authority; Article 3, Applications and Permits; Article 4, Zoning Districts; Article 5, Use Regulations; Article 6, District Intensity Standards; Article 7, Design Standards; Article 8, Environmental Protection; Article 9, Landscaping and Buffering; Article 10, Parking and Loading; Article 11, Sign Standards; Article 12, Infrastructure and Public Improvements; Article 14, Nonconformities; Article 15, Enforcement; and Article 16, Definitions.
The amendments are grouped into five categories:
• Amendments necessary to reflect a change to the name of the State Division of Water Quality;
• Amendments to Section 2.5, Historic Preservation Commission, to remove duplicative standards with the rules of procedure or interlocal agreement as similarly done with the Board of Adjustment and Planning Commission, and Sec. 3.16, Historic District or Landmark Designation, to correct district initiation process and remove unnecessary plan requirements;
• Amendments identified as necessary corrections, clarifications, re-organization, or other minor changes to more accurately comply with the intent of the regulations or codify interpretations of regulations;
• Amendments that reflect minor policy changes and are not solely technical in nature; and
• Additional changes to the standards for wireless communication facilities (WCFs) (paragraph 5.3.3N) as discussed through the adoption process of text amendment TC1200013.

TC1500002 – Technical Changes: UDO Graphics. A text amendment consisting of new and/or revised graphics to better illustrate certain standards within the UDO. These standards include Sec. 6.8, Infill Development in Residential Districts; Sec. 9.9, Fences and Walls; Sec. 10.4.4, Design Standards for Bicycle Parking; and Sec. 16.3, Defined Terms.
TC1500006 – Reasonable Accommodations. A text amendment to establish a process for allowing individuals with disabilities a mechanism for relief, or reasonable accommodation as required by the federal Fair Housing Act and Americans with Disabilities Act, from requirements of the UDO through a quasi-judicial approval process.
TC1500007 – Technical Changes: Revisions Due to State Legislation. A text amendment to revise certain sections of the UDO to comply with recently enacted state legislation.
The text of the proposed amendments may be viewed at http://durhamnc.gov/415/Pending-Text-Amendments, and will be reviewed by the Joint City-County Planning Committee (JCCPC) on February 3rd to provide comments and additional policy direction. The JCCPC does not hold public hearings, although its meetings are open to the public. No public hearings have been scheduled at this time.
