BOCC Regular Session Highlights from May 23rd

Durham, N.C. - The Durham Board of County Commissioners (BOCC) met on Monday, May 23, 2022, in Regular Session. Meetings are again being held in person, in the BOCC Chambers, located at 200 E. Main Street on the second floor.


  *   Chair Brenda Howerton called the meeting to order at 7 p.m.
  *   The audience was led in the Pledge of Allegiance by Vice Chair Wendy Jacobs.
  *   Chair Howerton asked everyone to observe a moment of silence in recognition of the victims of the horrific mass shooting that occurred on Saturday, May 14th in Buffalo, New York.

  1.  DCo Public Health COVID-19 Vaccination Clinic Hours - The COVID-19 vaccination clinic at the Durham County Department of Public Health, 414 E. Main St., has the following hours to get your free vaccination: Monday, Wednesday, Thursday & Friday: 9 a.m. to 4 p.m.; Tuesday: 9 a.m. to 5:30 p.m. Appointments and walk-ins welcome. All doses available. Please note, clinics are closed between 11:30 a.m.-1 p.m. daily.   3.  Way to Go Durham Program - Durham commuters interested in saving up to 75 percent on their community costs versus driving their own personal vehicle can now take advantage of discounted vanpools thanks to a new subsidy from the City of Durham Transportation Department's Way to Go Durham program.   4.  Sheriff Speaks Series - Durham County Sheriff Clarence F. Birkhead will travel to area libraries to connect his office with the larger Durham community with the "Sheriff Speaks" series. The first will be at Main Library, 300 N. Roxboro St., on May 24 at 5:30 p.m. The first session will address crisis intervention, mental health, community resources, and public safety.   5.  Durham County Government to Recognize Memorial Day - Most Durham County Government offices will be closed in recognition of Memorial Day on Monday, May 30.   6.  Memorial Day Remembrance - Everyone is invited to join our Durham County Veteran Services staff as we hold a Memorial Day remembrance event on Monday, May 30 in front of the Administration I Building at 200 E.   7.  Durham County World Hunger Day Event - Everyone is encouraged to attend the Durham County World Hunger Day event on June 4 from 3 to 6 p.m. at Durham Central Park, 501 Foster St. Come celebrate all that food means with friendship, music, arts, and fun.   8.  Become a Foster Parent - The month of May is Foster Care Month and Durham County Social Services is actively seeking foster families. Do you have a safe and nurturing home?   9.  Calling Youth 14-24 - Volunteer for Kids Voting Durham - KVD is offering youth virtual and hybrid Civic Leadership service learning opportunities this summer. Civic Leadership interns will earn service hours; gain valuable leadership, facilitation and team-building skills; and work with an awesome team of youth & adult allies and interact with Durham decision-makers.   10. Construction Starts June 6 at 500 East Main Street - Residents and commuters are advised that beginning Monday, June 6 construction will begin at the 500 East Main Mixed Use Development. This will impact pedestrian and vehicular travel, as well as parking for the Human Services Building at 414 E. Minutes


  *   The Minutes of the May 2, 2022, Work Session and the May 9, 2022 Regular Session were approved.

Ceremonial Items


  *   The Board proclaimed May 30th as Memorial Day 2022 in honor and in remembrance of Durham County's 375 known soldiers, sailors, Marines, airmen who died at war and all those who have died in service to the United States during peace and war in defense of our country's rights, values, and freedoms.   *   Vice Chair Jacobs read a proclamation for May as Eligibility Worker (also known as Income Maintenance Worker) Month in Durham County. This is to recognize Durham County eligibility staff for the significant difference they make in the lives of needy families and individuals, aged adults, foster children, and families in transition. A summary of the Consent Agenda follows:


  *   The Board of Commissioners approved a Budget Ordinance Amendment to recognize $5,257.04 from the North Carolina Department of Public Instruction's Child Nutrition Program for the Youth Home.


  *   The Board approved a contract amendment between the County of Durham and Tyler Technologies in the amount of $20,000 for the Register of Deeds.


  *   Commissioners received and approved the Durham County Juvenile Crime Prevention Council's (JCPC) Local Funding recommendation for FY 2022-2023 in the amount of $701,101.


  *   The Board approved the interlocal agreement between Durham County and the ABC Board to provide maintenance services to ABC locations, with the ability to renew for 5 consecutive years.


  *   County Commissioners approved execution of a contract with Summit Design and Engineering for Construction Materials Testing and Special Inspections Services for the New Durham County Youth Home, in the amount of $227,795 plus 10 percent (10%) contingency in the amount of $22,780.00.


  *   County Commissioners accepted the property tax release and refund report for April 2022 and authorized the Tax Assessor to adjust the tax records accordingly.


  *   The Board approved a Budget Ordinance Amendment for Public Health to appropriate $341,864 within the Public Health Budget to purchase a New Mobile Medical Unit and authorized the County manager to execute the contract.


  *   County Commissioners approve an amendment to the lease between Durham County and Thirumala Hospitality Durham, LLC. extending the Rent Commencement Date to the earlier of 60 days after Tenant's opening for business, or January 1, 2023.



  *   The Board approved a Budget Ordinance Amendment appropriating $500,000 of General Fund fund balance for contracted services within the General Government function.

Public Hearings


  *   Board conducted a public hearing on the proposed zoning map change application for Parmer Sector 3 (to change the zoning designation of a portion of one parcel of land located 2102 and 2152 So Hi Drive) Following the public hearing, they voted 5-0 to approve the zoning map change and to adopt the appropriate statement of consistency.


  *   The Board conducted a public hearing to receive citizen input on the FY 2022-23 County Manager's recommended budget. Approximately 30 comments were made about the budget concerning salary increases for county staff and sheriff's employees, funding of the new Youth Home, Renewable Energy and ARPA funding. Written comments were also submitted prior to the meeting via the Budget Portal on the County's website.

Other Business


  *   The Board received a public health focused update from County Public Health staff on the COVID-19 response and efforts. Public Health Director Rod Jenkins said people are becoming less cautious with their masks and safety protocols. Durham County has seen a steady increase in the past few weeks and our positive case rate is currently 15.5%.  The CDC has Durham County in the yellow zone in its data reports. To be clear, COVID remains present, so everyone needs to remain careful and be safe. At the end of the day, he reminded everyone to remain vigilant. He noted that home tests are readily available, but there are at least 30 locations in Durham County that provide COVID testing at this point. Visit the Durham County Public Health website to information about immunization times and details. Appointments and walk-ins are welcome, and all doses are available.


  *   County Commissioners received the update from representatives of Family Connects Durham. Family Connects Durham (formerly called Durham Connects), a program of the nonprofit agency the Center for Child and Family Health, is a community-wide nurse home visiting program for parents of newborns, regardless of income or socioeconomic status.


  *   The Board heard a proposed amendment to Durham County's Animal Control Ordinance to allow a Trap, Neuter, Vaccinate and Release Program for feral cats. They then provided direction to staff regarding next steps and to schedule a Public Hearing for the July 11th meeting.

Board and Commission Appointments


  *   The Board made appointments to the following boards:
     *   Bicycle and Pedestrian Advisory Commission - Monica Green
     *   Durham County Women's Commission - Roberta Price
     *   Durham Hospital Corporation Board of Trustees - Constanza Gomez-Joines, Hector Hidalgo and Paul Mosca
     *   Durham Racial Equity Commission - Jadda Richardson

The Board voted unanimously, 5-0, to go into closed session pursuant to G.S. 143-318.11(a)(5). They returned and gave direction to staff.

Commissioners voted unanimously to excuse Vice Chair Jacobs from the June 27, 2022 meeting.

Finally, the Board adjourned the meeting at 10:39 p.m.
