The Durham City-County PlanningDepartment processes application requests for voluntary annexation</div>

petitions. Per North Carolina State Law, to avoid gaps in the transfer of zoning jurisdiction, the City</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
Council must establish initial zoning of annexed areas within 60 days of the annexation.</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
The initial zoning can be accomplished in two formats, 1) a request by the applicant to amend the base</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
zoning, or 2) a direct translation of the base zoning (no change in the applied zoning, only jurisdiction).</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
In past years, the direct translation cases have not been presented to the Planning Commission for</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
recommendation prior to being presented to City Council due to a blanket resolution that was adopted</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
by the Durham Planning Commission under previous state statutes. The current state statutes related</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
to zoning amendments, specifically N.C.G.S. Section 160D-604(b) and N.C.G.S. Section 160D-102(34),</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
require the planning board/commission to review and make recommendations on initialzoning.</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
As such, all direct translation zoning cases will be reviewed by the Planning Commission prior to review</div>
<div style="font-family: Calibri, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);">
and action by the City Council. Due to the additional public hearing, notification fees will increase. The</div>
