Pat, Thanks for all the help! Final push for Tuesday's hearing. Anyone could attend and wear something orange to demonstrate to the board, with out having to say anything,  that there is support beyond a handful of inconvenienced neighbors:

This project is once again going before the Board of Adjustment on Tuesday April 24th.
Although this project is still in open litigation, Durham County Planning has allowed the developer to open the same case with a new number and continue pursuing this site.
The superior court judge did rule that the Little River Corridor Open Space Plan is a valid part of the situation. This was not the county's legal council at the first BOA hearing (Feb '17).
This long range plan was adopted by Durham and is part of The Comprehensive Plan. It has been found pertinent to the following situation by NC Superior Court.
The Discovery Charter School plan for Orange Factory Road violates the LRCOSP in at least 4 areas:

1. Destroying a portion of  South Reservoir Wildlife Habitat Area issue (p. 76, 38-44, 65/3, 93)
Not only would some area be destroyed, in order to be effective habitat acres must be contiguous. This would divide the area into two areas with little value to interior species.
2. No community scale waste water treatment systems in the LRC (p.31, 48, 49/3, 106)
    This plan has a 6,000 gallon/day system with a 3,000gal/day septic field.
3. Orange Factory Road is one of 4 roads specified in the LRCOSP "to preserve and enhance the scenic quality along" p.46, 72
Many trees would be removed. Many would have the critical root area removed in the proposed road widening. One home may even become uninhabitable.
  4. Wildlife Movement Corridors p. 93: the perennial stream which crosses the property could not be buffered with LRCOSP recommended distance. The stream would receive 1/2 the run-off of the sport field. A new roadway crossing and major alteration to an existing crossing would be necessary.

Even as the city/county completes the Flat River Open Space Plan, we hope the LRCOSP is shown to be worth the time, money and effort that was spent to develop it.
