There is a major loophole that needs to be closed to
allow citizen and gov't concerns to be met for this
rezoning (and others like it in the future).
Currently, this rezoning application (and its
approval) requires NO development plan (and, thus,
nothing to communicate with neighbors) and NO ability
to attach committed elements. How can this be?
The following information for Rezoning Z07-41 (near
Lake Park (Grandale)) came from the Planning
Department:
"The rezoning request is for RS-10, which does not
require that a development plan be attached. The
applicant has elected to not include one even though
the staff has advised them that they should consider
doing so in order to address potential concerns from
the surrounding property owners and neighborhoods.
The staff recommendation is for approval based on
compatibility with the Comprehensive Plan and that the
use and potential lot sizes are consistent with the
uses in the general area. We are unable to attach any
restrictions on the development because of the lack of
a development plan. Without a development plan it is
not possible to attach committed elements.
The site is located within the Countys jurisdiction
and will be forwarded to the County Commissioners for
final decision."
I hope that you will ask the joint city county
planning commission and the board of county
commissioners to oppose this rezoning based on the
lack of a plan, communication with neighbors,
committed elements, and the need for closing this
loophole as soon as possible.
