This clarifies what it means to have adverse effects on the neighbors (see below) and adds a requirement for minor special use permit for TV etc. towers.

New antenna-supporting structures/tower shall be configured and located in a manner that minimizes adverse effects including visual impacts on adjacent properties within 300 feet or the proposed height of the tower, whichever is greater, of the property under consideration. The applicant shall demonstrate with specific information that alternate locations including existing towers and buildings, configurations, and facility types, mass and scale, height, painting, lighting, and materials have been examined and shall justify the proposed alternatives in terms of effects on properties within 300 feet or the proposed height of the tower, whichever is greater, of the property under consideration.

Please be advised of the upcoming proposed changes to the text of the Durham Unified Development Ordinance (UDO): Text Amendment TC1100001 proposes revisions relating to broadcast towers to the following sections of the Unified Development Ordinance: Sec. 5.1, Use Table; Sec. 5.3, Limited Use Standards, and Sec. 16.3, Defined Terms. The proposed revisions would 1) require minor special use permits for the towers to provide nearby property owners with notice and opportunity to participate in the review process; 2) ensure that illumination is the minimum required by federal law; and 3) improve consideration of alternatives to reduce impacts on nearby properties. The Durham County Board of Commissioners will hold a public hearing on TC11000001 on Monday, May 9, 2011 at 7:00 p.m. in the Commissioners’ Meeting Room, 200 East Main Street. The text of the proposed change may be viewed at www.durhamnc.gov/council/ord_changes/ . Agenda documents will be available at http://www.durhamcountync.gov/departments/bocc/Agendas/Agenda_Attachments/Upcoming_Land_Use_Items.html. Interested parties may appear at the public hearing.
