This goes to Council on June 20th and the BOCC on June 27th.
It is a brand new type of zone:
4.3.1 Commercial Infill (CI)
The Commercial Infill (CI) District is established to provide for small commercial
and mixed use nodes within the Compact Neighborhood and Urban Tiers. These
nodes are intended to provide for pedestrian-oriented development that supports the
surrounding residential neighborhoods, and have limited vehicular accommodation.
The CI District is only appropriate in locations that have direct access to residential
neighborhoods. Businesses within the District should be sited to maximize visibility,
convenience, and accessibility for pedestrians.
The CI District is used to implement the Comprehensive Plan within those areas
shown as the Urban and Compact Neighborhood Tier.
I think I read through the proposed rules when they went to the Planning Commission. I also think that whatever is in the text now, we will probably find out from bitter experience some more conditions we need in the rules.

Please be advised of the upcoming proposed changes to the text of the Durham Unified Development Ordinance (UDO): Text Amendment TC1000006 proposes revisions relating to creating the Commercial Infill District to the following sections of the Unified Development Ordinance: Sec. 1.10 Transitional Provisions; Sec. 4.1, General; Sec. 4.3, Nonresidential District Intent Statements; Sec. 5.1, Use Table; Sec. 6.2, Residential Rural (RR) Development Intensity; Sec. 6.3, Residential Suburban (RS) Development Intensity; Sec. 6.4, Residential Urban (RU) Development Intensity; Sec. 6.5, Residential Compact (RC) Development Intensity; Sec. 6.9, Nonresidential Development in Residential Districts; Sec. 6.10, Nonresidential District Development Intensity; Sec. 9.4, Project Boundary Buffers; Sec. 9.6, Street Trees; Sec. 9.8, Vehicular Use Area Landscaping; Sec. 9.9, Fences and Walls; Sec. 10.3, Required Parking; Sec. 10.4, Design Standards; Sec. 10.7, Loading Areas; and Sec. 16.3, Defined Terms. The proposed revisions would 1) establish the Commercial Infill District; 2) create the standards for that district; 3) format sections of the ordinance to match standardized formatting; and 4) allot for on-street parking credits for multi-use developments in the Urban Tier. The proposed text amendment would create a new commercial zoning district, Commercial Infill, to be applied in the Urban and Compact Neighborhood Tiers only. It includes changes that support a related zoning map change proposed in case Z1000011. The proposed text amendment also includes changes that clarify existing requirements to district intensity standards and landscaping and buffering standards in the City and County of Durham. The Durham City Council will hold a public hearing on TC1000006 on Monday, June 20, 2011 at 7:00 p.m. in the City Council Chambers at 101 City Hall Plaza, 1st Floor. The text of the proposed change may be viewed at www.durhamnc.gov/council/ord_changes/ . Agenda documents will be available under “Agendas” at http://www.durhamnc.gov/council/.
