In an unexpected  move in this morning's House Environment committee, Rep. Becky Carney (D-Mecklenburg) offered a substitute bill for SB 428, Study Consolidated Environmental Commission.  

The new version of the bill restores language similar to that approved last year by the House to ensure that local government authority was protected in sweeping changes to the state's rules allowing  tree-cutting around billboards.  



SB 183, Selective Vegetation Removal  was one of the most debated and controversial laws of the 2011 session.  The House voted to the Senate bill to protect the integrity of local tree-ordinances and investment in other local beautification projects in the review and approval process for issuing tree-cutting permits to billboard companies. However, the provisions affecting  local government control the provisions affecting local government control were largely removed in conference committee.



In supporting Rep. Carney's proposal today, bill sponsor Rep. Becky Carney and House Majority Whip Ruth Samuelson said there was confusion among House members who voted for the final version of the bill as it came out of conference committee that local government jurisdictional authority was still in the bill.  The new bill clarifies the House intent.



SB 428, Selective Vegetation Removal now heads to the House floor. The original bill has passed the Senate.
