It turns out that the Urban Growth Boundary is mentioned in the UDO in only a couple places, and this takes those few references out.

THis is the definition of "family care" --A dwelling that provides room and board for not more than six persons 
who because of age, illness, handicap, or specialized program, require 
personalized services or a supervised living arrangement in order to 
assure their safety and comfort that is regulated by the State of North 
Carolina.   

Family care homes would be prevented from being too close together, but would not need minor use permits or not have any language about, for example, being compatible with the neighborhood.  In particular, it doesn't look like we would even require that they meet state standard.

Please be advised of the upcoming proposed changes to the text of the Durham Unified Development Ordinance (UDO):   Text amendment TC1200010 proposes changes to Article 4, Zoning Districts; and Article 16, Definitions, of the Unified Development Ordinance to remove references to an urban growth area (UGA). Text amendment TC1200011 proposes changes to Article 5, Use Regulations, to establish separation requirements for family care and group homes. The Durham Planning Commission will hold public hearings on TC1200010 and TC1200011 on Tuesday, January 8, 2013, at 5:30 p.m. in the City Council Chambers at 101 City Hall Plaza, 1st Floor.   Agenda materials will be available online by December 27, 2012. Interested parties may appear and speak at the public hearing.  Substantial changes to the proposed action may be made following the public hearing.
