I disagree.  As written, the school gets the use permit not if the required
storm water documentation is approved by the BOA, but by the city staff in
various agencies.  The ordinance can require them to submit the SIA
sufficiently in advance that staff has time to comment, but it can't give
staff approval authority.

This has what looks like a small technical correction to keep trailers out
of street yards, and then adds this language

 

4. Modular School Classrooms 
When modular classroom units are needed to accommodate additional enrollment
at a public school facility, a temporary use permit can be issued subject to
the following: 



1.	Documentation provided by the applicant verifies the units are
needed to 
accommodate additional student enrollment; 
2.	Documentation provided by the applicant specifies the anticipated
amount of 
time needed for the modular units; 
3.	A stormwater impact analysis (SIA) provided by the applicant, to be
reviewed and 
approved by the City Public Works Department, or the County Engineering
Department, as applicable, shall be submitted when units are proposed on a
pervious surface. Improvements determined necessary based upon an approved
SIA shall be installed prior to receiving a Certificate of Compliance for
the modular units; 
4.	Documentation provided by the applicant that demonstrates the
existing parking facilities can accommodate the additional classrooms, or
additional parking spaces shall be provided, per Article 10, Off-Street
Parking and Loading. 
5.	The temporary use permit shall be valid for a year, and can be
renewed on a yearly basis provided the same documentation demonstrating
conformance to Ordinance requirements is submitted.

Text amendment TC1200009 proposes changes to Article 5, Use Regulations, to
revise the temporary use permit process for modular school classroom units
when needed only for enrollment purposes and when adequate parking is
available, while requiring stormwater impact analysis if the units are
located on pervious surfaces. 

 

The Durham City Council will hold public hearing on TC1200009 on Monday,
February 18, 2013, at 7:00 p.m. in the City Council Chambers at 101 City
Hall Plaza, 1st Floor.
