[MCIC Safety] Voluntary Respiratory Protection Use

An MCIC Member has requested help on the following issue:

We have a situation here where an employee is asking to wear a 
respirator in an area which, according to indoor air quality sampling 
data, respiratory protection is not required.  Although OSHA does 
address this scenario, they are vague, as usual, as to the company's 
choice on the matter.

Does anyone have a program in place and what the potential liabilities?
