The Durham City-County PlanningDepartment processes application requests for voluntary annexation
petitions. Per North Carolina State Law, to avoid gaps in the transfer of zoning jurisdiction, the City
Council must establish initial zoning of annexed areas within 60 days of the annexation.
The initial zoning can be accomplished in two formats, 1) a request by the applicant to amend the base
zoning, or 2) a direct translation of the base zoning (no change in the applied zoning, only jurisdiction).
In past years, the direct translation cases have not been presented to the Planning Commission for
recommendation prior to being presented to City Council due to a blanket resolution that was adopted
by the Durham Planning Commission under previous state statutes. The current state statutes related
to zoning amendments, specifically N.C.G.S. Section 160D-604(b) and N.C.G.S. Section 160D-102(34),
require the planning board/commission to review and make recommendations on initialzoning.
As such, all direct translation zoning cases will be reviewed by the Planning Commission prior to review
and action by the City Council. Due to the additional public hearing, notification fees will increase. The
planning staff are in the process of contacting applicants impacted by this change. If you have any
